Controversy Over Program to Help Homeowners Sue Realtors and Builders

Released on = January 29, 2007, 9:48 am

Press Release Author = Damion Rutherford

Industry = Construction

Press Release Summary = Black-Mold-Remedation.com, and informational portal for
homeowners with mold problems, announces plans to devise a program geared to educate
the consumer on their rights to sue.

Press Release Body = A Cincinnati women sues her home builder for $75 million
because of dangerous mold growth in her home. A Texas family wins $32 million
settlement because of black mold. Hilton Hotels spends $55 million to fix mold
problems in the Hilton Hawaiian Village\'s Kalia Tower. And the lawsuits are just
starting to heat up. The big wave hasn't even hit yet.

So why would a small internet-based company want to help homeowners jump on the
lawsuit bandwagon?

"These examples are certainly not the norm - they are the exception. For every big
lawsuit like this, you have thousands upon thousands of homeowners and renters who
are suffering without anyone to help them.", said Damion Rutherford, creator of the
website.

"The builders and realtors know, or at least should, about the problems. They have
legions of high-paid lawyers and hidden print in contracts to protect them. The
homeowner has nothing", added Damion.

So Just How Big Will These Lawsuits Get?

When asked this question, Damion's comment was very empathetic. "I'd hate to say."
Was all he needed to say. The message was delivered.

"You have to realize that this is an unregulated field. There are no guidelines or
standard practices to determine what is acceptable and what is not. Your family can
be bleeding from the lungs, and no one wants to take responsibility. Not the
builder, not the realtor, not the landlord, and especially not the insurance
company.", Damion added.

"All major insurance companies have added exclusions for mold coverage to their
policies. Until a standard has been set for this industry, it's going to be a mess.
The next asbestos."

Fighting For The Homeowners Rights

With such a scare right now in the community about mold growth, a homeowner has very
few options to deal with the problem. Opinions vary greatly as to a proper method to
safely remove mold growth.

"I could have taken several different approaches to this. We could have been an
advocate for setting the standard. We could have even pushed an educational forum
for the professionals. But I do not think either of these will address the problem
with urgency. It's best to hit them in their pockets", said Damion.

And that's just what the website will do. Black-Mold-Remediation.com will be
launching a new program to educate homeowners on their rights. Articles, guides,
downloadable workbooks and materials are planned to be included.

So What About The Lawsuits?

"I have no intention for this to be a 'learn how to sue' program. Its really the
exact opposite. We want to educate the homeowner or renter on the problem, the fact
that they are on their own, and how to attempt to receive help with the issue. If
they've exhausted all of these options, the homeowner/renter needs to know what the
proper steps are to push it to the next level."
